Guam Senators Set Aside Bill Allowing for Accessory Dwelling Units

During a legislative session on Wednesday, Guam senators set aside a bill that would allow for the construction of “accessory dwelling units” on the same lot as a single-family home in residential zones. The bill, known as Bill 51-37, will undergo another public hearing scheduled for July.

Sen. Chris Duenas, the sponsor of the bill, emphasized the need for affordable housing solutions in Guam. The accessory dwelling units would be detached or attached studio-type apartments of 400 to 800 square feet in size, also known as “mother-in-law” homes that homeowners can build on their lots in a residential zone.

Duenas believes that allowing families to build these extra structures beside their homes could provide a solution to the affordable housing crisis on the island. Despite concerns raised by the Guam Association of Realtors, Duenas was able to move the bill out of committee last week.

However, during Wednesday’s session, oversight chairperson Speaker Therese Terlaje introduced a substitute bill with amendments to address some of the concerns raised. One of the main concerns was to prevent the accessory dwelling units from being used as short-term vacation rentals.

Sen. Sabina Perez expressed support for the bill’s potential to increase the housing supply for local families but also cautioned against the possibility of it becoming a speculative market that could drive prices up.

Following discussions on the substitute bill, Duenas agreed to set aside Bill 51-37 and hold a public hearing in July to allow constituents to express their concerns and provide feedback on the proposed changes.

The new hearing date for Bill 51-37 has not yet been scheduled, but it is clear that the issue of affordable housing in Guam remains a top priority for lawmakers.
